I am from Ukraine, I was in Poland before 24.02.22. Can I apply for a temporary residence card?

The stay of a Ukrainian citizen in Poland on the basis of a national visa (and its’ extension) is legal until June 30, 2024, provided that the last day of stay in Poland on the basis of the this visa was in the period from February 24. It is not possible cross the border based on an extension of the national visa.

In a situation where the last day of the permissible period of stay of a citizen of Ukraine on the territory of the Republic of Poland falls in the period from February 24, 2022, the stay in Poland shall be considered legal until  June 30, 2024, if the citizen of Ukraine remains in Poland:

– on the basis of a Schengen visa issued by a Polish authority or another Schengen area state

– on the basis of a residence permit issued by another Schengen area state,

– within the framework of visa-free movement

If the last day of the period of validity of a temporary residence permit granted to a citizen of Ukraine falls within the period from February 24, 2022, the period of validity of this permit shall be extended by operation of law until  June 30, 2024.

If the validity of residence cards, Polish identity documents of a foreigner, “consent for tolerated stay” documents issued to citizens of Ukraine expires in the period from February 24, 2022, their validity is extended until June 30, 2024.

The extension to June 30, 2024 also applies to the deadlines for a citizen of Ukraine to leave the territory of Poland (from Article 299, paragraph 6 of the Foreigners Act, hereafter u.c.) and the deadlines for voluntary return (from Article 315, paragraph 1 u.c.), which fell within the period from February 24, 2022.
